南阳师范学院学报

我国《涉外民事关系法律适用法》已于2011年4月1日正式实施。作为新中国制定的第一部较为完善和系统的国际私法法规,它广泛吸收了当代国际私法先进理论,成功借鉴了当今世界各国立法经验并充分总结了我国三十年来的立法与司法实践经验。本文结合我国《涉外民事法律适用法》的有关调研,对以一般涉外合同和一般侵权为代表的涉外债权的法律适用分别进行了理论的阐述和实践的总结,并就后续的法律修正和完善提出了自己的意见和建议。

The Law on the Application of Laws to Foreign-related Civil Relationships of the People's Republic of China,effective as of 1 April,2011,is the first relatively complete and systematic law in the New China which formulates the rules of private international law.This law has extensively taken in the advanced theories of contemporary private international laws,successfully drawn upon the legislative experience of countries the world over,and comprehensively summarized the practical legislative and judicial experience of China over the past three decades.Based on relevant research and survey on the Law on the Application of Laws to Foreign-related Civil Relationships of the People's Republic of China,the paper theoretically elaborates on and practically summarizes the application of laws to creditor's rights in foreign-related civil affairs,especially to such typical cases involving foreign-related contracts and torts.Comments and suggestions are also made pertaining to the ensuing revision,amendment,modification,and supplementation of this law.
