2010年10月,《中华人民共和国涉外民事关系法律适用法》将最密切联系原则规定为国际私法的一般原则,以立法的形式确认了该原则在国际私法中的地位,彰显了最密切联系原则的重要性。伴随产生的问题是,最密切联系原则应该如何对整个涉外民事法律关系进行调整,最密切联系原则的适用方式是什么?为解决此问题,本文从最密切联系原则的本质属性入手,阐述了该原则适用方式研究的必要性,最终确立了"法律关系要素分析说"作为最密切联系原则适用方式,以期能为司法实践服务。

The doctrine of the most significant relationship was prescribed as one of the general principles of private international law in the Law of the Application of Law for Foreign-related Civil Relations of the People's Republic of China adopted in October 2010.The identification of its status in private international law through the form of legislation highlights the importance of the doctrine of the most significant relationship.However,there are still concomitant problems pertaining to how the doctrine of the most significant relationship regulates the entire foreign-related civil relations and what the means of application of the doctrine are.To solve these problems,this paper expounds the necessity of research on the means application of the doctrine of the most significant relationship from the perspective of the nature and essential attributes of this doctrine.The paper ultimately proposes the principle of "factor analysis of legal relations" as the means of application of the doctrine of the most significant relationship in the hope of contributing to judicial practices.
